OBAMACARE RECUSAL

ravf_obamaobeyThe highest court in the land has apparently lost the nerve to cross the man seated in the Oval Office. A recent request for a Supreme Court debate as to whether Elena Kagan should recuse herself from hearing the upcoming ObamaCare pleadings has been flatly denied.

It is time for Congress to step in and do their job – maintain the balance of powers and protect the integrity of the high court.

"I have complete confidence in the capability of my colleagues to determine when recusal is warranted," said Chief Justice Roberts in his year-end report.

The absurdity of this statement is apparent in Kagan's steadfast refusal to remove herself from the ObamaCare case. As chief appellate lawyer for the Obama administration, Elena Kagan openly supported the ObamaCare law, and celebrated its passage even as under her direct supervision her own staff in her own office began organizing arguments in defense of the law they knew would be challenged. Emails in which Kagan discussed the law with staffers have already been released.After heading the department preparing to defend ObamaCare in court, not to mention managing the attorneys assigned to defend Obama's "signature legislation," it is simply illogical to assume Kagan could be impartial.

Even Democrats agree, Kagan must recuse herself if any semblance of ethics is to be maintained by the high court. Well known liberal law professor Eric J. Segal recently wrote:

Publicly available e-mails … and other evidence, demonstrates that the Office of the Solicitor General was involved in discussions about how to defend the ACA, and it is undisputed that Justice Kagan was the head of that Office…"

The integrity of the Supreme Court, and what remains of our system of co-equal branches and balance of powers, is imperiled by Kagan's arrogant refusal to recuse herself from this case and the rest of the Court's willingness to "play dead" for the Obama administration.

ravf_obamacarepoemA great beauty and strength of our republic lies in the system of checks and balances our Founding Fathers laid out over 200 years ago. They foresaw a time when one branch would attempt to outgrow its equal and co-governing status and so they provided us with a remedy – the people's voice. We must now in unison compel our elected representatives in Washington to do their job, provide oversight and accountability, and stop the tyranny that seeks to destroy the Constitution. Congress must demand integrity on the Court in order to preserve the republic.
