In NY it's possession that is illegal. I checked with my FFL and he said the state could argue the "intent" to make an illegal firearm could be used if a "kit" with the tools were in your possession. This was several years ago and under then current laws. Anything that evades the two part FFL - NICS illegal database keepers of firearm sales /possession tracking is called illegal. Go figure.
